Service

By creating an account or using the Service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the Service.

Mustsy is a ticket price tracking and alert service that allows users to monitor resale ticket prices for live events including concerts and sporting events. The Service allows users to:

• Set seat preference parameters (section, row, quantity)
• Set target price thresholds for specific events
• Receive notifications when matching tickets become available at or below their target price
• View historical price data for tracked events

Mustsy is an informational and alerting service only. We do not sell tickets, hold ticket inventory, guarantee ticket availability, or process ticket transactions. All ticket purchases are made directly through third-party platforms.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@mustsy.com if you suspect any unauthorized use of your account. We reserve the right to terminate accounts at our sole discretion.

All payments are processed through Stripe. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Refunds are issued at our sole discretion and are not guaranteed except where required by applicable law. We reserve the right to change pricing at any time with reasonable notice to subscribers.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, scrape, or systematically extract data from the Service
• Use automated bots or scripts to interact with the Service
• Resell, redistribute, or commercialize alert data obtained through the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure

The Service integrates with and displays data from third-party ticketing platforms including but not limited to SeatGeek, StubHub, Ticketmaster, and TickPick. We do not control these platforms and are not responsible for their content, pricing accuracy, availability, or terms of service. Links or redirects to third-party ticket listings are provided for convenience only. Your interactions with third-party platforms are governed by their respective terms of service.

We strive to provide accurate and timely pricing data. However, ticket prices and availability change rapidly and we cannot guarantee that prices or seat availability displayed in alerts reflect real-time conditions at the moment of purchase. We are not responsible for pricing discrepancies, sold-out listings, or any losses arising from reliance on alert data. Always verify prices and availability directly on the ticketing platform before purchasing.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by MustSy LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MUSTSY LLC EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MUSTSY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Pro tier users may opt in to receive SMS notifications for seat price alerts. By providing your phone number and activating SMS alerts in your account settings, you expressly consent to receive automated text messages from Mustsy at the number provided.

• Consent: You consent to receive automated transactional SMS messages related to your seat alerts. Consent is not a condition of using the Service or creating an account.
• Message frequency: Message frequency varies based on the number and activity of your alerts. You will only receive messages when matching seats are found at or below your target price.
• Costs: Standard message and data rates may apply according to your mobile carrier's terms.
• Opt-out: You may cancel SMS notifications at any time by replying STOP to any message, disabling SMS in your account settings, or contacting us at legal@mustsy.com. After opting out, you will receive one final confirmation message.
• Re-opt-in: To resume SMS alerts after opting out, reply START or UNSTOP to any message, or re-enable SMS in your account settings.
• Support: For help, reply HELP to any message or email us at legal@mustsy.com.
• Liability: MustSy LLC is not liable for delayed or undelivered messages caused by carrier issues, network problems, or other factors outside our reasonable control.

You agree to indemnify and hold harmless MustSy LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas. You consent to the personal jurisdiction of such courts. Any claim must be brought within one (1) year of the date the cause of action arose.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date and, where appropriate, by notifying you via email or in-app notification. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive.

Mustsy is a ticket price tracking and alert notification service. Mustsy does not sell tickets, hold ticket inventory, issue tickets, process ticket transactions, or act as a broker or marketplace for tickets of any kind.

All ticket purchases facilitated through links in the Mustsy application or website are completed directly on third-party resale platforms including but not limited to SeatGeek, StubHub, TickPick, VividSeats, Ticketmaster, and Gametime. Mustsy is not a party to any transaction between you and these platforms.

When you click a purchase link in Mustsy you are leaving the Mustsy service and entering a third-party platform subject to that platform's own terms of service, privacy policy, refund policy, and buyer guarantee programs. Mustsy has no control over and accepts no responsibility for the terms, policies, or actions of these third-party platforms.

Mustsy is not responsible for:

• Ticket authenticity or validity
• Event cancellations or postponements
• Refunds or exchanges for ticket purchases
• Fulfillment of ticket orders
• Any loss arising from ticket transactions conducted on third-party platforms

Ticket prices on resale platforms change frequently, often within seconds, and without notice. Prices displayed in Mustsy represent the best available information at the time of our most recent data check and may not reflect current pricing or availability at the time you view them or attempt to purchase.

Mustsy checks prices at intervals ranging from 15 minutes to 6 hours depending on your subscription tier. Significant price changes may occur between checks.

Mustsy does not guarantee that:

• Any displayed price will be available when you attempt to purchase
• Any listed tickets will still be available when you click through to a platform
• Alert notifications will be delivered within any specific timeframe
• All price matches will be detected

Mustsy is not liable for any difference between a displayed price and the actual price at time of purchase, for sold-out inventory, or for any financial loss arising from reliance on price information displayed in the Mustsy service.

Always verify current pricing and availability directly on the ticket platform before completing any purchase.

Mustsy participates in affiliate advertising programs with third-party ticket platforms. When you click a link to a ticket platform from Mustsy and make a qualifying purchase, Mustsy may receive a referral commission from that platform. This commission is paid by the platform and does not result in any additional cost to you.

Affiliate relationships do not influence the prices, listings, or platforms displayed in Mustsy. Our alert system monitors all connected platforms based on price and availability data only. We do not prioritize or deprioritize any platform based on affiliate status or commission rates.

This disclosure is made in compliance with the Federal Trade Commission Act (15 U.S.C. § 45) and the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255). See our full Affiliate Disclosure.

Mustsy sources ticket pricing, event information, performer data, and venue information from third-party APIs and data providers including SeatGeek, TicketsData, and Ticketmaster. Mustsy does not independently verify the accuracy of data obtained from these sources.

Event information including dates, venues, lineups, and performer details is subject to change without notice. Event cancellations, postponements, venue changes, and lineup changes may not be immediately reflected in the Mustsy service.

Mustsy is not responsible for inaccuracies in third-party data or for any loss arising from reliance on event or pricing information displayed in the service.

Always verify event details directly with the official venue or authorized ticket seller before making any purchase decision.

Mustsy alert notifications are provided on a best-effort basis and are subject to the following limitations:

• Alerts depend on the availability and accuracy of third-party pricing data
• Alerts depend on internet connectivity and third-party platform uptime
• Email and push notification delivery is subject to email provider and device notification settings outside our control
• Price matching algorithms may not detect all listings that meet your criteria
• Listings that trigger an alert may sell out before you receive or act on the notification

MUSTSY PROVIDES THE ALERT SERVICE 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTY OF ANY KIND. MUSTSY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR ALERT WILL BE DELIVERED OR WILL RESULT IN A SUCCESSFUL TICKET PURCHASE.

MUSTSY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE ALERT SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MUSTSY IN THE THREE MONTHS PRECEDING THE CLAIM.

Mustsy displays pricing data sourced from licensed third-party APIs. All event names, performer names, team names, venue names, and related trademarks are the property of their respective owners. Mustsy makes no claim of ownership over any third-party intellectual property displayed in the app.

Performer images displayed in Mustsy are sourced from SeatGeek's public API under their terms of service.

Mustsy Pro subscription cancellations and refund policy details are described in our Refund Policy. Mustsy does not process ticket sales and cannot issue refunds for ticket purchases — those requests must be made directly to the platform of purchase.
